& Consumer Information for Sellers

    We provide these forms for your education.  Please take the time to print out and read over each one.  Depending on the property you are selling, you will use most of these for an existing home sale.  As always, feel free to call to discuss any questions, or for copies of contract forms for other property types that you want to sell (i.e. Farm & Ranch, Lots, Leases, Commercial, New Construction).  Spanish translations of most forms are available by request.

Information About Brokerage Services  Describes how brokers can represent the parties to a transaction. Spanish Version

Residential Listing Agreement  Form - TAR for a seller to retain the services of Texas Ranch and Home Realty for the sale of property.

Seller's Disclosure Notice - TAR  Section 5.008 of the Texas Property Code requires a seller of residential property on not more than one dwelling unit to deliver a Seller's Disclosure Notice to a purchaser on or before the effective date of a contract.  This form complies with and contains additional disclosures which exceed the minimum disclosures required by the Code. 

Seller's Disclosure Notice - Austin MLS  Form from the Austin-Central Texas Realty Information Service (MLS)

Information About On-Site Sewer Facility  Form used to inform buyer of all of seller's information on the septic system.

Keybox Authorization by Tenant  Facilitates the showing of a property that is occupied by a tenant.  See Landlord-Tenant Guide.

Residential Resale Contract  Standard contract for sale of an existing 1 to 4 Family Residence.

Third Party Financing Addendum  The buyer's loan contingency.

Seller Financing Addendum  Used when Seller finances all or part of the purchase price.

Addendum for Mandatory HOA  Used when the property is subject to mandatory membership in a homeowners association.

Non-Realty Items Addendum  Used when transferring personal property as part of the real estate contract.  For instance: refrigerator, playscape, washer/dryer, etc.

Contingency for Sale of Other Property  If the buyer must sell another property before they can purchase yours.

Seller's Disclosure of Info. on Lead-Based Paint  Federal requirement on any residence built prior to 1978.

Seller's Temporary Residential Lease  Should you need to occupy the home for a short period after closing and funding.

Buyer's Walk-Thru and Acceptance  Notice that the buyer has performed an inspection, and approves the current condition, and any repairs negotiated.

Farm and Ranch Listing Agreement  Suited for any property that has agricultural use.  Generally for tracts larger than 10 acres. 

Commercial Property Condition Statement  Suitable for any property that does not easily classify as a standard residence; such as Farm & Ranch Properties, Vacant Land, Commercial Properties.

SELLER INFORMATION AND NOTICES

Protect Your Family from Lead in Your Home  Pamphlet describing potential lead hazards in a residence.  Federal law requires Seller to provide this to the buyer if home built prior to 1978.

Protecting Your Home from Mold  Pamphlet with information on mold and prevention.  From TX Department of Health & TX Department of Insurance.

Information about Property Insurance  Notice to seller and buyer concerning the availability and costs of property insurance.

Information about Special Flood Hazard Areas  Notice to buyer that property is in "flood plain" and information on insurance.  

Consumer Notice Concerning Hazards and Repairs  Notice that Licensed Inspectors must report certain conditions as needing repair.

Settlement Costs & Helpful Information  Pamphlet describing the HUD-1 Settlement Statement and general costs associated with selling a property.
